Privacy Policy

Protecting your personal data is important to us. Below we inform you which data we process when you visit this website and when you use our forms, for what purpose this happens, to whom we disclose it and what rights you have.

Last updated: August 2026

The key points at a glance

  • This website does not use any analytics, statistics, tracking or advertising services. We do not create user profiles and we do not evaluate your behaviour.
  • At most a single, technically necessary cookie is stored, which remembers your language selection. That is why we do not need a consent banner.
  • The font is delivered from our own server – there is no connection to Google Fonts or any other external font service.
  • The website is hosted in Germany and can only be accessed with TLS encryption (HTTPS).
  • Data that you send us via one of our three forms is used exclusively to process your enquiry or your application.

I. Information on the processing of your data pursuant to Art. 13 GDPR

1. Controller and data protection officer

The controller for the data processing on this website within the meaning of Art. 4(7) GDPR is:

Immobilien & Consulting SAM GmbH

trading as “Personalagentur SAM”

Billstedter Hauptstraße 1-15

22111 Hamburg

Represented by the managing director: Hidayet Sakarya

Email: info@personalagentur-sam.de

Phone: 04154 / 598 02 37

The complete provider information – for example on the registry court and the licence for temporary employment – can be found in our imprint.

Data protection officer

We have not appointed a data protection officer. The statutory requirements for an obligation to appoint one do not apply to us (Art. 37(1) GDPR, Section 38(1) BDSG (German Federal Data Protection Act)).

For all questions concerning data protection and the exercise of your rights, please contact us directly:

2. Data processed for the provision of the website and the creation of the log files

a) Which data is processed and for what purpose?

When you access this website, your browser automatically sends technical data that is required to deliver the page. This data is recorded in the connection logs of the systems involved. The following is transmitted:

  • Date and time of access
  • IP address of the requesting device
  • Host name of the accessing computer
  • Website from which the access is made (referrer)
  • the pages and files accessed
  • Status message indicating whether the request was successful
  • the volume of data transferred in each case
  • browser type used and its version
  • operating system used

This data is technically necessary so that the page can be delivered to your browser and displayed there correctly. Beyond that, it serves the stability and security of our system, in particular the detection and prevention of attacks as well as troubleshooting.

No evaluation for marketing or analytics purposes takes place. The log data is not merged with other data sources and is not used to draw conclusions about you personally.

b) Legal basis of the processing

The legal basis is Art. 6(1) sentence 1 (f) GDPR. Our legitimate interest lies in providing the website in a technically flawless manner and protecting it against misuse.

c) Further recipients of the data

The log data is generated at our hoster and in the upstream security and delivery network; both are described in more detail under no. 3. These providers process the data as processors exclusively on our behalf and in accordance with our instructions.

No disclosure beyond this takes place. This does not apply to disclosure to law enforcement or other authorities, insofar as we are legally obliged to do so or insofar as this becomes necessary for legal prosecution in the event of attacks on our infrastructure.

d) Storage period

No permanent access logs containing IP addresses are kept on our own server. Only technical operating messages of the application are generated there (such as start-up and error messages). These do not contain any visitor IP addresses and are overwritten automatically as soon as a defined storage limit is reached.

The connection data transmitted when the page is accessed is, by contrast, generated in the upstream security and delivery network (see no. 3 b) and is deleted there in accordance with the provider's retention periods. We do not evaluate these logs for analytics or marketing purposes.

3. Hosting, delivery and encryption

a) Hosting (Hetzner Online GmbH)

This website is hosted with Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. The servers used are located in a data centre in Germany (Nuremberg).

Hetzner processes the log data referred to under no. 2 as well as all other data arising in connection with the operation of this website exclusively on our behalf and in accordance with our instructions. A data processing agreement pursuant to Art. 28 GDPR has been concluded with Hetzner. The legal basis for the use is Art. 6(1) sentence 1 (f) GDPR – our legitimate interest in the professional, secure operation of the website.

Hetzner's privacy policy

b) Delivery and attack protection (Cloudflare)

All data traffic of this website runs via the delivery and security network (content delivery network) of Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA; represented in Germany by Cloudflare Germany GmbH, c/o Design Offices München Atlas, Rosenheimer Straße 143C, 81671 München.

Cloudflare is thus technically interposed between your browser and our server and in doing so inevitably processes your IP address as well as the technical details of your request. The purpose is the fast and reliable delivery of the page content, the encryption of the connection and protection against overload and other attacks (e.g. DDoS).

The legal basis is Art. 6(1) sentence 1 (f) GDPR. Our legitimate interest lies in the secure, available and trouble-free operation of the website.

Cloudflare is a company based in the USA; processing of data outside the EU or the EEA can therefore not be ruled out. The basis for the transfer are the standard contractual clauses of the EU Commission pursuant to Art. 46(2)(c) GDPR, which form part of the data processing agreement (Data Processing Addendum) concluded with Cloudflare. Despite these safeguards, it cannot be entirely ruled out that US authorities may access the data.

Cloudflare's privacy policy

c) Domain and email mailbox (IONOS SE)

Our domain is registered with IONOS SE, Elgendorfer Str. 57, 56410 Montabaur; our email mailbox is also operated there. Messages that you send us via one of the forms or directly by email arrive in this mailbox and are stored there.

In this respect, IONOS acts for us as a processor pursuant to Art. 28 GDPR. The legal basis for the use is Art. 6(1) sentence 1 (f) GDPR.

IONOS's privacy policy

d) Encrypted transmission (TLS/HTTPS)

This website can only be accessed via a TLS-encrypted connection; unencrypted requests are automatically redirected to the encrypted address. The certificate used is issued by Let’s Encrypt.

You can recognise an encrypted connection by the fact that your browser's address bar begins with “https://” and displays a padlock symbol. As long as the encryption is active, the data you transmit to us cannot readily be read by third parties.

4. Cookies

A cookie is a small text file that a website stores in your browser. This website makes do with exactly one cookie:

Name
NEXT_LOCALE
Purpose
Stores the language version you have selected so that you do not have to switch again the next time you access the site.
Content
Only the two-letter language code (e.g. “de” or “tr”) – no identifier by which you could be recognised.
Setting
SameSite=Lax; the cookie is therefore not sent to third-party websites.
Storage period
It is set as a session cookie without a fixed expiry time and is deleted at the latest when you close your browser.

This cookie is strictly necessary in order for us to provide you with the service you have expressly requested – the website in your language. Its storage is therefore permitted without consent pursuant to Section 25(2) no. 2 TDDDG (Telekommunikation-Digitale-Dienste-Datenschutz-Gesetz, German Telecommunications Digital Services Data Protection Act). We base the subsequent processing on Art. 6(1) sentence 1 (f) GDPR.

We do not set any further cookies. In particular, we do not use any analytics, statistics, marketing or tracking cookies, no web analytics services such as Google Analytics, no map services, no social media plugins and no advertising networks. For this reason there is also no consent banner on this website: there is nothing for which we would have to obtain consent.

You can block cookies in your browser in general or delete them selectively. If the language cookie is not available, the website remains fully usable – the language is then determined from the page address each time you access it.

5. Fonts and embedded content

The font used on this website is delivered from our own server. When the pages are accessed, no connection is therefore established to Google Fonts or any other external font service; your IP address is not transmitted to anyone for this purpose.

The same applies to images, icons and scripts: they are likewise stored on our server. We embed external content only at the one point described under no. 6 – the bot protection on our form pages.

6. Bot and spam protection (Cloudflare Turnstile)

In order to protect our forms against automated entries (spam bots), we use Cloudflare Turnstile, a service of Cloudflare, Inc. (for the address see no. 3 b).

If you access a page containing a form, your browser loads a script for this purpose from the address challenges.cloudflare.com. In doing so, your IP address is transmitted to Cloudflare. On the basis of technical characteristics of your browser, Turnstile checks whether the entry originates from a human and issues a one-time verification token for this, which we verify with Cloudflare when the form is submitted.

According to the provider, Turnstile does not set any cookies for advertising or tracking purposes and does not use the data collected either to build user profiles or to display advertising.

The legal basis is Art. 6(1) sentence 1 (f) GDPR. Our legitimate interest lies in protecting our forms and our mailbox against abusive and automated submissions. With regard to the third-country aspect, what is stated under no. 3 b applies accordingly.

7. Contact form, staffing request and application

Three forms are available on this website. All three work on the same principle: we do not store your entries in a database on the web server, but deliver them directly as an email to our mailbox (see letter e).

Mandatory fields are marked in the respective form; all other details are voluntary. Before submitting, you confirm by ticking a box that you have taken note of this privacy policy.

a) Contact form (“Contact” page)

The following is collected:

  • First name and last name
  • Email address
  • Phone number (voluntary)
  • Your message

Purpose: processing and answering your enquiry.

Legal basis: if your enquiry is aimed at the conclusion or performance of a contract, this is Art. 6(1) sentence 1 (b) GDPR. In all other cases we base the processing on Art. 6(1) sentence 1 (f) GDPR – our legitimate interest lies in being able to respond to matters brought to our attention.

Storage period: we store your enquiry for as long as this is necessary to process it and then delete it, at the latest once the underlying matter has been concluded. This applies unless statutory retention obligations prevent deletion – in particular the commercial and tax law periods pursuant to Section 257 HGB (German Commercial Code) and Section 147 AO (German Fiscal Code).

b) Staffing request for companies (“Companies” page)

The following is collected:

  • Name of the company
  • Name of the contact person
  • Email address
  • Phone number (voluntary)
  • Industry or area (warehouse & logistics, production & manufacturing, trades & industry, office & administration or other)
  • Type of requirement (temporary staffing, recruitment, contract for work or not yet clear)
  • Your message

Purpose: review and processing of your staffing requirements as well as the preparation of a quotation.

Legal basis: Art. 6(1) sentence 1 (b) GDPR, as the processing is necessary in order to carry out pre-contractual measures at your request. Insofar as this concerns contact data of employees of the enquiring company, we additionally base the processing on Art. 6(1) sentence 1 (f) GDPR (interest in functioning business communication).

Storage period: as under letter a. If a collaboration comes about, the statutory retention periods of up to ten years apply to the contract and billing documents.

c) Application form (“Applicants” page)

The following is collected:

  • First name and last name
  • Email address and phone number
  • Place of residence and postcode (voluntary)
  • earliest possible starting date or the indication “immediately”
  • desired area or desired position
  • desired working model (full-time, part-time, shift work, mini-job or flexible)
  • driving licence classes held and forklift licence
  • Your message
  • Your consent to the processing for the purpose of the application

In addition, you can upload application documents: up to five files in PDF, JPG, PNG or Word format, each no larger than 5 MB and no more than 7 MB in total. These files are not stored on our web server. They are only checked in the main memory and delivered directly to our mailbox as an attachment to the application email.

Please note: you decide for yourself which documents you upload. We ask you to refrain from providing information that is not necessary for the application – in particular special categories of personal data pursuant to Art. 9 GDPR such as health data, religious affiliation or trade union membership. If you nevertheless transmit such data, we will only process it insofar as this is necessary for the decision on your application (Section 26(3) BDSG) or you have expressly consented.

Purpose: conducting the application procedure and – where a suitable opportunity arises – your placement with or assignment to a client company (see no. 8).

Legal basis: Art. 6(1) sentence 1 (b) GDPR in conjunction with Section 26(1) sentence 1 BDSG. The processing is necessary for the decision on the establishment of an employment relationship. Insofar as you voluntarily provide us with further information, the legal basis is your consent pursuant to Art. 6(1) sentence 1 (a) GDPR, which you can withdraw at any time with effect for the future.

Storage period: if no collaboration comes about, we generally delete your application documents six months after the conclusion of the application procedure. This period is based on the periods for asserting claims under the General Equal Treatment Act (Section 15(4) AGG, Section 61b(1) ArbGG (German Labour Court Act)) plus a safety margin. If you would like us to keep your documents beyond that for future positions (applicant pool), we will ask you separately for your consent; this too can be withdrawn at any time. If an employment relationship comes about, your data is transferred to the personnel file.

d) Protection of the forms against misuse

All three forms are additionally protected by technical means:

  • An additional field that is invisible to you (“honeypot”) is only filled in by automated programs. If it is filled in, we discard the submission without any email being sent.
  • A limit on the number of submission attempts per IP address – no more than eight submissions within ten minutes – prevents mass flooding of our mailbox. For this purpose your IP address is held exclusively transiently in the main memory of the server instance and is discarded once the time window has elapsed, at the latest upon the next restart. No permanent storage or merging with other data takes place.
  • The bot protection Cloudflare Turnstile described under no. 6.

The legal basis in each case is Art. 6(1) sentence 1 (f) GDPR; our legitimate interest is protection against abusive and automated use of our forms.

e) Dispatch and delivery of the form messages

For the technical dispatch of the emails we use the service Brevo of Brevo GmbH, Köpenicker Str. 126, 10179 Berlin (parent company: Brevo SAS, Paris, France). In doing so, Brevo processes the contents of the respective form including the uploaded application documents exclusively for the purpose of delivering this message to us. no-reply@personalagentur-sam.de is used as the sender address.

Brevo acts for us as a processor pursuant to Art. 28 GDPR. The legal basis for the use is Art. 6(1) sentence 1 (f) GDPR – our legitimate interest in the reliable and traceable receipt of your message.

After sending, you will receive an automatic confirmation of receipt at the address you provided; this is also sent via Brevo.

The messages are delivered to our email mailbox at IONOS (see no. 3 c). There they are stored until the matter has been finally processed and until any statutory retention periods have expired.

Brevo's privacy policy

8. Disclosure of applicant data to client companies

As a staffing service provider, we place applicants with companies or assign them to those companies within the framework of temporary agency work. For this purpose it may be necessary to pass on your profile and your application documents to a specific assignment or client company.

Such disclosure never takes place automatically and never without your knowledge. If a position is a possible fit for you, we will first write to you by email, name the specific company and ask you whether we may transmit your documents to it. Only once you have given us your consent do we pass on your data. If you do not reply or if you decline, no transmission takes place.

The consent applies in each case only to the company named in the request. For every further position and every further company we will ask you again. The legal basis is your consent pursuant to Art. 6(1) sentence 1 (a) GDPR. You can withdraw it at any time without any particular form and with effect for the future – a message to the address stated under no. 1 is sufficient. The lawfulness of the transmission carried out up to that point remains unaffected.

The recipients are exclusively those companies to which you have consented in the individual case. They subsequently process your data under their own responsibility for their personnel selection.

9. Contacting us via WhatsApp

On this website we offer you the option of writing to us via WhatsApp. This is exclusively an ordinary link to the address wa.me. We do not embed a WhatsApp widget, a chat window, a tracking pixel or a script from WhatsApp or Meta in our pages. As long as you do not click the link, no data whatsoever is transmitted to WhatsApp or Meta.

If you click the link, WhatsApp opens on your device or WhatsApp Web opens. From that point onwards, WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, processes your data under its own responsibility in accordance with its own provisions; we have no influence over this. WhatsApp belongs to the Meta group, so a transfer of data to the USA cannot be ruled out.

The use of WhatsApp is entirely voluntary – you can just as easily reach us by email, by telephone or via our forms.

Please do not send us any sensitive data via WhatsApp. This applies in particular to complete application documents, identity documents as well as health data and other particularly sensitive information. Please use the application form or email for this.

If you write to us via WhatsApp, we process the content you transmit in order to answer your request. The legal basis is Art. 6(1) sentence 1 (b) GDPR where a contract or its initiation is involved, otherwise Art. 6(1) sentence 1 (f) GDPR.

WhatsApp's privacy policy (EEA)

10. Obligation to provide data and automated decision-making

You are under no legal or contractual obligation to provide us with personal data. Without the information marked as a mandatory field in the forms, however, we cannot process your enquiry or your application.

Automated decision-making including profiling within the meaning of Art. 22 GDPR does not take place. Enquiries and applications are decided on exclusively by humans.

11. Your rights as a data subject

With regard to the personal data concerning you, you have the following rights vis-à-vis us:

  • Right of access (Art. 15 GDPR): you can request information as to whether and which data we process about you, for what purpose this happens, to which recipients we disclose it and how long we store it.
  • Rectification (Art. 16 GDPR): if your data is inaccurate or incomplete, you can request its rectification or completion.
  • Erasure (Art. 17 GDPR): you can request the erasure of your data, provided that no statutory retention reason prevents this.
  • Restriction of processing (Art. 18 GDPR): in certain cases – for example while we verify the accuracy of your data – you can request that we restrict the processing instead of erasing the data.
  • Data portability (Art. 20 GDPR): data that you have provided to us on the basis of consent or a contract will be provided to you on request in a common, machine-readable format; on request we will also transmit it directly to another controller.
  • Right to object (Art. 21 GDPR): you can object to processing that we base on a legitimate interest. Details on this can be found in section II.
  • Withdrawal of consent (Art. 7(3) GDPR): if you have given us consent, you can withdraw it at any time with effect for the future. The lawfulness of the processing carried out up to the withdrawal remains unaffected.
  • Complaint to a supervisory authority (Art. 77 GDPR): you can lodge a complaint with a data protection supervisory authority if you are of the opinion that the processing of your data infringes the GDPR.

II. Right to object pursuant to Art. 21(1) GDPR

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Art. 6(1) sentence 1 (e) or (f) GDPR. On this website this concerns in particular the processing operations described under numbers 2, 3, 4, 6 and 7 d.

If you lodge an objection, we will no longer process the data concerned. This applies only unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless the processing serves the establishment, exercise or defence of legal claims.

The objection is not subject to any particular form. A message to the contact details stated under no. 1 is sufficient – ideally with the keyword “objection”.

III. Changes to this privacy policy

We will adapt this privacy policy as soon as the technology used on this website, the service providers we use or the legal requirements change. The version published on this page applies in each case.

For questions about data protection you can reach us at any time using the contact details stated under no. 1.
